CLIENT ACKNOWLEDGMENT AND AGREEMENT (SNP-ACK r7) By placing this order, you ("Client") acknowledge, represent, and agree as follows:
1. Contracting Party. Client is entering into a binding agreement with Snaptera Texas, LLC d/b/a 154 Photography ("154 Photography") with respect to the services and media identified in this order. The individual placing this order represents that they are authorized to do so on behalf of Client and to bind Client to this agreement.
2. Terms of Service and Media License. Client has read, understands, and agrees to abide by the 154 Photography Terms of Service, available at
www.154photography.com/terms, and the applicable Media License, available at
www.154photography.com/licensing, each of which is incorporated into this agreement by reference.
3. Access and Operating Environment. Client shall provide, or cause to be provided, access to the property at the time and place identified in the scheduled appointment, and shall ensure a safe and suitable operating environment for 154 Photography personnel and equipment, including, without limitation, premises free of hazards, free of aggressive or unrestrained animals, free of pest infestation, maintained in sanitary condition, with active electrical service and working lighting in every interior room or area included in the scheduled services.
4. Authority. Client represents and warrants that Client is authorized to schedule the services and to provide access to the property as described in Section 3.
5. Condition of the Premises. Client agrees that 154 Photography shall not be responsible for loss or damage to the property arising from reasonable efforts to enter, open, operate, or move about the premises in the ordinary course of the services, where such loss or damage results from a pre-existing, worn, or defective condition of the property or its doors, gates, locks, fixtures, or furnishings. 6. Rescheduling and Cancellation Fees. Appointments may be cancelled or rescheduled without charge before the day of the appointment. Client is aware of, and agrees to pay, a
$100 cancellation fee for appointments cancelled on the day of the appointment and a
$50 rescheduling fee for appointments rescheduled on the day of the appointment, as further described in the Terms of Service. An appointment that cannot proceed at the scheduled time because the conditions described in Sections 3 through 5 are not satisfied may be treated as a same-day cancellation.
7. Text Messages. By providing a mobile telephone number with this order, Client agrees to receive appointment-related text messages from 154 Photography (the 154 Photography Appointment Notifications program). Message frequency varies, typically 2 to 3 messages per appointment; message and data rates may apply. Reply STOP to any message to opt out (opting out does not affect this order) or HELP for assistance. Consent is not a condition of purchase. Checking the acceptance box and clicking "Schedule Now" constitutes Client's electronic signature and acceptance of this agreement under the Texas Uniform Electronic Transactions Act.
